1. Acceptance of Terms
By accessing and using the Better Buds website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, users, and customers of Better Buds.
2. Age Verification & Legal Requirements
You must be at least 19 years of age (18 in Alberta) to use our services and purchase cannabis products. By using our services, you represent and warrant that you meet the minimum age requirement for your province or territory. You must provide valid government-issued identification when required. We reserve the right to verify your age and identity at any time.
3. Product Information & Accuracy
While we strive to provide accurate and up-to-date information about our products, we do not guarantee the accuracy, completeness, or reliability of any product descriptions, pricing, or availability as we work with best information we are given or have on each respective product. Product images are for illustrative purposes only and may not reflect the exact appearance of the product. We reserve the right to modify product information without notice.
4. Ordering & Payment Terms
All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion. Payment must be completed via Interac e-Transfer as specified during checkout. Orders are not confirmed until payment is received and processed. You agree to provide accurate billing and shipping information. Any false or fraudulent information may result in order cancellation. Please note: Unless another option is selected on checkout page, if an item is out-of-stock, a substitute item will be shipped out that will be chosen by our team that is deemed similar to the best of our abilities and product availability. There are no refunds or exchanges in these cases.
5. Shipping & Delivery
We use Canada Post XpressPost (or Purolator Express or similar delivery service providers during any Canada Post service disruptions) for all deliveries. Shipping times are estimates and may vary based on location and circumstances beyond our control. We are not responsible for delays caused by Canada Post, Purolator, weather, or other external factors that are outside of our control. Delivery delays, service disruptions, or any issues with shipping providers are not our responsibility and do not entitle you to refunds or compensation. All packages require signature upon delivery unless the ‘No Signature’ option is selected during checkout. By selecting ‘No Signature’, you accept full responsibility for package delivery. If an order is made available for pickup at a location provided by the carrier, we are not responsible if you fail to pick up the order at that location. It is your responsibility to collect your order from the designated pickup location within the time frame specified by the carrier.
6. Returns & Refunds
Due to the nature of cannabis products and the industry, we do not accept returns or provide refunds under any circumstances. This includes but is not limited to: product dissatisfaction, allergic reactions, or shipping delays. If you have concerns about your order, please contact our customer service team.
6a. Reporting & Resolution of Issues
For items such as vape products, if you experience any issues with your purchase, you must report the issue within 14 days of receiving the item. All issue reports must include a clear video demonstrating the problem. Upon review of your report and video, we may, at our sole discretion, offer either a replacement product or a discount/credit on your next order. The decision to provide a replacement or discount/credit, and the amount of any discount/credit, is entirely at the discretion of our team. Failure to report issues within the 14-day window or failure to provide a clear video demonstrating the issue may result in your request being denied.
6b. Rewards, Bonus Points & Promotional Gifts
Any reward points, bonus points, promotional credits, bonus gifts, or similar customer benefits (“Rewards”) are offered solely at our discretion. We may withhold, deny, reduce, revoke, cancel, or adjust Rewards at any time, with or without notice, and for any reason or no reason, including (without limitation) system glitches or errors, suspected or actual abuse, fraud or scam activity, account irregularities, or violations of our policies. Rewards have no cash value unless expressly stated otherwise and are not guaranteed.
7. Privacy & Data Protection
Your privacy is important to us. We collect, use, and protect your personal information in accordance with our Privacy Policy. By using our services, you consent to our collection and use of your information as described in our Privacy Policy. We implement appropriate security measures to protect your data, but no method of transmission over the internet is 100% secure.
8. Prohibited Uses
You agree not to use our services for any unlawful purpose or in violation of these terms. This includes but is not limited to: providing false information, circumventing age verification, fraudently attempting to cancel or stop a payment after an order has been processed, or using our services for any malicious or harmful reasons. We reserve the right to terminate your access to our services and account for any violation of these terms.
9. Coupons & Promotions
Better Buds may, from time to time, offer special promotional deals and limited-time coupon codes to help you save on your favorite products. Please be advised that all coupon codes are intended for individual use only and are strictly limited to one per transaction. By default, promotional coupons cannot be combined or “stacked” with any other offers, existing store credits, Reward Points, or specialized pricing programs.
Furthermore, unless a specific promotion explicitly states otherwise in writing, all coupons are excluded from application toward Mix & Match Bundles, Bulk Items, and Wholesale orders, as these items are already provided at a significant discount. We reserve the right to verify the eligibility of any coupon used and may, at our sole discretion, cancel or adjust any order where a coupon has been applied in violation of these terms or due to a system error. All promotional benefits are offered as a courtesy and may be modified, suspended, or revoked at any time without prior notice.
10. Reward Points Program
Better Buds provides a loyalty program as a courtesy to our valued customers, allowing you to earn store credit on retail purchases. Under this program, you will earn 1 Reward Point for every $1 spent on the website. These points are automatically calculated based on the subtotal of your order (excluding shipping costs or already discounted amounts) and are credited to your account dashboard once the order status is marked as “Completed.” Every 100 Reward Points accumulated can be redeemed for $1 in store credit to be applied toward the subtotal of future orders.
Please note that these Reward Points are offered solely at our discretion and have no cash value. We reserve the right to withhold, reduce, or revoke points at any time, without notice, for reasons including but not limited to system glitches, suspected fraud, account irregularities, or violations of these Terms. A maximum of $100 (10,000 points) in store credit can be applied to any single order. Reward points cannot be used to cover shipping costs and cannot be combined with other coupons, discounts, or promotional offers. While our rewards are designed for retail items, all bulk, wholesale, Mix & Match, and special orders are ineligible for standard reward promotions and will instead be rewarded with a flat 1% credit. Furthermore, if you choose to receive Reward Points as a credit for a substitute item, those points remain subject to all limitations and discretionary policies outlined herein.
11. Refer a Friend Program
Our “Refer a Friend” Program is designed to reward existing customers (“Referrers”) for introducing new, unique customers (“Referees”) to Better Buds. To participate, Referrers must have an active account in good standing. Upon the successful completion of a Referee’s first purchase using your unique referral link or code, the Referrer will be granted a one-time 25% Off Coupon (valid for 180 days) and 2,000 bonus Reward Points. To ensure both parties benefit, the Referee will receive 2,000 bonus Reward Points (1,000 via the 25OFF1 coupon code and 1,000 as a referral bonus) in addition to the standard points earned on their purchase.
Participation in this program is a privilege, not a right. We reserve the absolute right to refuse or revoke referral rewards if we suspect fraudulent activity, such as users referring themselves, creating multiple accounts, or attempting to game the system. Referral coupons are for personal use, are non-transferable, and cannot be combined with other promotions. Better Buds reserves the right to modify, suspend, or terminate the Refer a Friend program or change the reward structure at any time without prior notice. By participating, you acknowledge that the final determination of eligibility for any referral bonus rests solely with the Better Buds team.
12. Bulk / Wholesale Orders & Products
Please note that terms and conditions for Bulk / Wholesale orders differ from regular retail orders and are subject to product availability and approval. Reward points, reward multipliers, promo codes, discount programs, and loyalty offers do not apply to Mix & Match or Bulk / Wholesale items unless explicitly stated otherwise. Certain products or categories may also be subject to additional quantity restrictions or wholesale limitations. Delivery guarantees and expedited shipping timelines are not applicable to Bulk / Wholesale orders, and all bulk shipments are sent at the customer’s risk once transferred to the delivery carrier.
13. Limitation of Liability
To the maximum extent permitted by law, Better Buds shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid for the specific product or service giving rise to the claim. This limitation applies to all claims regardless of the legal theory on which they are based.
14. Indemnification
You agree to indemnify and hold harmless Better Buds, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these terms, or violation of any applicable laws or regulations. This includes reasonable attorneys’ fees and costs incurred in defending against such claims.
15. Right to Refuse Service & Termination
We reserve the right to refuse service, terminate accounts, or block access to our website for any individual at our sole discretion, without prior notice.
- Reasons for Termination: This includes, but is not limited to: disrespectful behavior, threats, spamming or harassment toward our staff; initiating stop-payments or fraudulent disputes; or any breach of these Terms.
- Forfeiture of Benefits: Upon the termination of an account or the blocking of a user for any reason, all accumulated reward points, loyalty credits, bonus gifts, and affiliate program commissions or benefits shall be immediately and permanently forfeited. Terminated users are not entitled to the value or redemption of any benefits earned prior to the moment of termination.
16. Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any modifications constitutes acceptance of the updated terms. We encourage you to review these terms regularly. If you do not agree to any modifications, you must discontinue use of our services.
